California Consumer Privacy Act (CCPA) Policy

This California Consumer Privacy Act ("CCPA") Policy supplements our Privacy Policy and applies solely to California residents ("consumers" or "you"). This Policy describes how Ninjahire Inc. ("we," "us," or "our") collects, uses, and shares your personal information and explains your rights under the CCPA.

1. Scope and Definitions

This Policy applies to California residents and covers personal information we collect, use, disclose, or sell. Under the CCPA, "personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

  • Name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license number, passport number, or other similar identifiers

  • Name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information

Protected Classification Characteristics Under California or Federal Law

  • Age, race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status

Commercial Information

  • Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies

Biometric Information

  • Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data

Internet or Other Similar Network Activity

  • Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement

Geolocation Data

  • Physical location or movements

Sensory Data

  • Audio, electronic, visual, thermal, olfactory, or similar information

Professional or Employment-Related Information

  • Current or past job history or performance evaluations

Non-Public Education Information

  • Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records

Inferences Drawn from Other Personal Information

  • Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes

3. Sources of Personal Information

We collect personal information from the following sources:

  • Directly from you: When you register for an account, use our Services, communicate with us, or provide information directly
  • Automatically: When you interact with our Services, including through cookies and similar tracking technologies
  • Third parties: From public databases, marketing partners, social media platforms, ATS systems, VMS systems, and other service providers
  • Service providers: From third-party service providers who assist us in providing our Services

4. Business or Commercial Purposes for Collecting Personal Information

We collect and use personal information for the following business or commercial purposes:

  • Providing Services: To provide, maintain, and improve our Services, including our AI talent platform
  • Processing Transactions: To process transactions and send related information
  • Communication: To communicate with you about our Services, respond to inquiries, and provide customer support

  • Analytics: To analyze usage patterns, trends, and activities to improve our Services

We do not sell personal information in the traditional sense. However, under the CCPA, "sale" is broadly defined and may include sharing personal information with third parties for valuable consideration.

We may share your professional personal information (such as your resume, skills, and work history) with companies seeking candidates for job opportunities. This sharing may be considered a "sale" under the CCPA. We only share this information:

  • With your explicit consent for specific job opportunities
  • When you apply for a job listing through our platform
  • When you opt-in to be contacted about job opportunities

Right to Know

You have the right to request that we disclose:

  • The business or commercial purpose for collecting or selling your personal information
  • The categories of third parties with whom we share your personal information
  • The specific pieces of personal information we have collected about you

Right to Delete

You have the right to request that we delete your personal information, subject to certain exceptions, such as:

  • Completing a transaction for which the information was collected
  • Detecting security incidents or fraud
  • Complying with legal obligations
  • Exercising free speech or other rights
  • Internal uses that are reasonably aligned with your expectations

Right to Opt-Out of Sale

You have the right to opt-out of the sale of your personal information. We provide a clear and conspicuous link on our website titled "Do Not Sell My Personal Information" that allows you to opt-out.

Right to Non-Discrimination

We will not discriminate against you for exercising your CCPA rights. We will not:

  • Deny you goods or services
  • Charge you different prices or rates
  • Provide you a different level or quality of goods or services
  • Suggest that you may receive a different price or rate or different level or quality of goods or services

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels, if the incentive is reasonably related to the value of your data.

Verification Process

We will need to verify your identity before processing your request. We may ask you to:

  • Provide information that matches information we have on file
  • Provide government-issued identification
  • Answer security questions

We will respond to your request within 45 days. If we need additional time, we will inform you of the reason and extension period (up to an additional 45 days).

10. Authorized Agents

You may designate an authorized agent to make a request on your behalf. To do so, you must:

  • Provide written authorization for the agent to act on your behalf
  • Verify your own identity directly with us
  • Provide the agent with written permission to submit the request

11. Children's Privacy

We do not knowingly sell personal information of consumers under 16 years of age. If you are a parent or guardian and believe we have collected information from your child under 16, please contact us immediately.

12. Data Broker Registration

We are a registered data broker with the California Department of Justice, as required by California Civil Code § 1798.99.80. This registration exempts us from providing notice at the time of data collection in certain circumstances.

We may update this Policy from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by posting the updated Policy on this page and updating the "Last updated" date.
